+ Add someone What you're accepting Heritage Lake is real water and people drown in it. The dock is slick, the lift is heavy machinery, the yard is steep, and the water hides rocks, stumps, and debris. There's no lifeguard and no supervision of any kind . Add storms, cold water, the grill, the stairs in the dark, ticks, alcohol, dogs, and the ordinary quirks of an older lake house. You're choosing to accept all of that — the risks listed here and the ones nobody thought to list — for yourself and everyone you bring.
The rules that aren't negotiable Nobody swims alone , and nobody swims after drinking or after dark.Kids near the water means an adult within arm's reach — not watching from the deck.Life jackets on every child, every non-swimmer, and everyone on any boat, always.No diving or jumping headfirst. The depth is unreliable and there's hard stuff down there.Guests don't drive our boat, touch the lift, or launch their own boats. If we take you out, it's a favor we can decline or end anytime, whoever's driving gives the orders, and jackets are on.You'll also follow the house rules on the Victory Hill site — occupancy, checkout, dogs, grill and fire, septic, quiet hours. They're part of this agreement. If the rules get broken we can ask your group to leave, and you'll go.

The legal part “The Owners” means Steven and Jessica Pollock , any entity holding title, and their family and agents. “You” means you, everyone in your group, and anyone claiming through you.
YOU ARE GIVING UP THE RIGHT TO SUE.
In exchange for use of Victory Hill, the dock, the water, and everything on the property, you release and permanently discharge the Owners from every claim of any kind — injury, illness, property damage or loss, and death — arising from your time here or from any boat, watercraft, or activity connected to it.
THIS INCLUDES CLAIMS CAUSED BY THE OWNERS' OWN NEGLIGENCE — negligent maintenance, repair, or inspection; negligent supervision or the absence of it; negligent operation of a boat or the boat lift; and negligent failure to warn of, or discover, any condition on the property or in the water, obvious or hidden, known or unknown.
You also agree to cover the Owners' costs, including attorney's fees, if anyone brings a claim arising from your stay — including someone in your own group — and to pay for anything your group damages beyond normal wear.
This doesn't release the Owners for willful or wanton misconduct, or anything else Indiana law won't let us release. The Owners carry no insurance for you, your group, or your belongings. Indiana law governs, in the county where the property sits; if a court strikes any part, the rest still stands. You don't have to sign this — but without it you can't use the property.
Initials I understand I'm giving up the right to sue, including for the Owners' negligence.
If you're bringing kids Nobody here is watching your children. Ever. Not us, not anyone. If we're on the property we're not babysitting, not watching the water, not counting heads. That's yours.
Signing as a parent or guardian means you're agreeing to everything above on your child's behalf too — individually, as parent, as guardian, and for their estate and heirs. If a claim gets brought for that child by anyone, you'll cover our costs. By signing you confirm that you have the authority of your spouse and of every other parent or guardian of every child in your group to agree to all of this on their behalf, and that you'll tell them what's on this page.
If a child gets hurt and we can't reach you, you're authorizing us to call 911 and consent to emergency treatment, at your cost.
